In 1961 ICS was the first shipping industry association to be granted consultative status at the UN International Maritime Organization (IMO). Since then, our secretariat has been regularly attending – and contributing to – the technical meetings. Our national association membership structure enables us to provide a well-balanced industry view, which we express through submissions.
ICSfully supports the submission made by Shipping Australia Limited in support of the maintenance of Part X of Australia’s Competition and Consumer Act (CCA). ICS agrees that the current regulatory environment in Australiaencourages container lines to competerobustly in terms of the quality of service that they provideand that the current approach,which has continued to be applied since the last major review of Part X in 2005,does not inhibit competition.

In summary, the international shipping industry is broadly satisfied with the status quo
with respect to the current text of the Convention, including Article 8. However, with
respect to the current text of Article 15, opinions within the shipping industry appear to
differ. ICS is cautious about commenting on proposed changes whose wider
implications are difficult to fully understand, despite having been carefully studied by our
members. ICS therefore suggests that the proposed changes to the OECD Model
Convention need to be subjected to a far more comprehensive review.
